Utah Means Test


In most cases when one files for bankruptcy they must take the means test to qualify for a chapter 7 bankruptcy. To see if one passes the Utah means test they can double their income from the past six months and compare it to the median income of a family of their size. The Utah means test numbers for cases filed after May 1, 2015 are as follows:


1 Person: $52,865
2 People: $59,546
3 People: $67,632
4 People: $73,446
5 People: $81,546
6 People: $89,646
7 People: $97,746


If one passes the means test they may be eligible for a chapter 7 or a chapter 13 with a three year repayment plan. If one’s income is higher than the means test they may be eligible for a chapter 7 if their expenses on secured debt are high enough but will have to complete the full means test and risk being required to convert a chapter 7 case to a chapter 13.
